Partner Hub Terms of Use
In accordance with the Partner Hub Terms of Use, below, by applying and being granted access to The Great Unwaste Partner Hub, on behalf of your organisation you agree that:
- Your organisation’s use of the Partner Hub is to genuinely help amplify The Great Unwaste behaviour change campaign with a view to reducing household food waste across Australia.
- You will not provide access to the Parter Hub to anyone outside of your organisation.
- You will not share downloadable files or assets with anyone outside of your organisation.
- In amplifying The Great Unwaste you will follow all instructions and guidelines provided in the Partner Hub to the best of your ability. You will not misrepresent The Great Unwaste.
- You will not bring The Great Unwaste or End Food Waste Australia into disrepute.
- Your organisation will respond to monthly requests from The Great Unwaste team to report on your use of Partner Hub resources and assets and any other activity to activate The Great Unwaste campaign.
- You will contact The Great Unwaste team if you have any concerns or issues using the Partner Hub or amplifying the campaign.
- You will address any feedback or instructions from The Great Unwaste team regarding your use of the Resources Hub and any materials downloaded or accessed.
- We have permission to communicate with you, including via electronic direct mailout (EDM), about The Great Unwaste and the Partner Hub (i.e agree to receive communications from us & be added to our mailing lists).
Terms of Use
End Food Waste Australia Limited (ABN 90 627 226 537) (“EFWA”, “we”, “us” or “our”) controls and operates The Great Unwaste Partner Hub which is made available to authorised users via its website at https://partners.thegreatunwaste.com.au/ (“Partner Hub“).
These terms and conditions are the terms and conditions of an agreement between the person accessing and/or using the Partner Hub (“you” or “your”) and us. Where you access the Partner Hub on behalf of your employer, these terms and conditions apply to your employer.
Terms
Your access to the Partner Hub is conditional upon your acceptance and compliance with the terms, conditions, notices, policies and disclaimers contained in this document and elsewhere on the Partner Hub (known collectively as “Terms of Use”).
Your use of, and/or access to, the Partner Hub constitutes your agreement to the Terms of Use. If you do not agree to the Terms of Use, please do not use the Partner Hub.
We reserve the right to amend the Terms of Use at any time by notice to you, which amendments will apply from the next time you log into the Partner Hub.
Security
As a registered user of the Partner Hub, you will receive or establish an account for your organisation which may include login details such as username and password (“Account“). You are responsible for maintaining the confidentiality and security of your Account. You agree not to reveal your Account information to anyone outside of your organisation. You shall ensure that access to your Account is limited to only those persons within your organisation who have a legitimate need to access the Partner Hub.
You are entirely responsible for all activities that occur on or through your Account, and you agree to immediately notify us of any unauthorised use of your Account or any other breach of security.
Copyright and Intellectual Property Rights
We may provide you with access to and permit you to download materials, content and functionality including without limitation any brochures, posters, images, hyperlinks, data, information and any other material via the Partner Hub (“Material”).
We own all intellectual property rights in and to the Partner Hub and in and to the Materials or use both or any of them under licence or applicable law. Our rights are protected by Australian and International law, including without limitation Copyright and Trade Mark law.
When you access the Partner Hub and Materials, you agree as follows:
- Materials indicated as downloadable may be downloaded by you, shared with your organisation and printed and used by your organisation in a manner consistent with the intent of The Great Unwaste campaign.
- You may not share Materials outside of your organisation, unless indicated by us with the Materials or agreed by us in writing.
- You may not modify the Materials, unless indicated by us with the Materials or agreed by us in writing.
- You may not remove any attribution or copyright notice from the Materials.
- You must not use the Partner Hub or any Materials for any purpose which is unlawful, prohibited under these Terms of Use or which violates any of our rights or those of any other owner of any rights in the Materials.
We expressly prohibit use of the Materials in any manner other than as expressly licensed in these Terms of Use or as expressly stated in relation to the Materials themselves.
Disclaimer of Warranties
Except where expressly stated, we make no representations about the currency, continued availability, accuracy, suitability or reliability of any Material. The Material is provided “as is” and without warranties of any kind, either express or implied including without limitation implied warranties of merchantability and fitness for any particular purpose. We reserve the right to update, amend or remove the Materials at any time.
We make no warranties that the function of, or access to, the Partner Hub will be ongoing, uninterrupted or error free, that any defects will be corrected or that any Partner Hub or server which stores and transmits any Material will be free of viruses or any other harmful components. We accept no responsibility for or liability in respect of such interruption, errors, defects, viruses or harmful components.
Limitation of Liability
To the full extent permitted by law, we shall not be responsible or liable for any loss or damage howsoever caused whether under statute, in contract, tort (including negligence) or otherwise (including without limitation any direct, indirect or consequential loss or damage, loss of profits, loss of data or loss of opportunity) whatsoever connected with, or arising as a result of any person acting or refraining from acting in reliance of the Material, accessing or using the Partner Hub or any associated Partner Hub links, or as a result of or in connection with any breach by you or anyone acting on your behalf of any of the terms of the Terms of Use.
Termination
The Terms of Use are effective until terminated by us, and we may terminate this agreement and your access to the Partner Hub at any time without notice. In the event of termination, you are no longer authorised to access the Partner Hub or to access or use the Materials, but all restrictions imposed on you and all our disclaimers and limitations of liability set out in the Terms of Use will survive termination.
General
The Terms of Use are governed and will be construed in accordance with the laws of South Australia, Australia. By agreeing to the Terms of Use you irrevocably and unconditionally accept and submit to the jurisdiction of the courts of the State of South Australia.
If any part of these Terms of Use is held to be unenforceable, the unenforceable part is to be given effect to the greatest extent possible and the remainder will remain in full force and effect.
